Section 1. Agreement to Terms

Welcome to JalwaClub Hotel. These Terms and Conditions constitute a legally binding agreement between you ("User," "you," or "your") and JalwaClub Hotel ("we," "us," or "our") governing your use of our website, services, and facilities.

By accessing or using our website, making a reservation, or staying at our properties, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

Section 2. Reservations and Bookings

2.1 Making a Reservation

Reservations may be made through our website, mobile application, or by contacting our reservations team directly. All reservations are subject to availability and must be confirmed by JalwaClub Hotel. We reserve the right to refuse any reservation at our sole discretion.

2.2 Reservation Guarantee

A valid credit card or other accepted payment method is required to guarantee your reservation. Some rates may require full or partial prepayment at the time of booking.

2.3 Rate Changes

Rates displayed on our website are subject to change without notice. Your confirmed reservation rate will be honored unless modified by mutual agreement or as provided in our cancellation policy.

2.4 Special Requests

Special requests (such as room preferences, early check-in, or late check-out) are subject to availability and cannot be guaranteed. We will make reasonable efforts to accommodate all requests.

Section 3. Cancellation and Refund Policy

3.1 Standard Cancellation

Cancellations made 48 hours or more prior to your scheduled arrival date will receive a full refund. Cancellations made within 48 hours of arrival may be subject to a cancellation fee equal to one night's stay.

3.2 Non-Refundable Rates

Certain promotional rates and packages are non-refundable. This will be clearly indicated at the time of booking. Non-refundable reservations cannot be cancelled or modified for a refund.

3.3 No-Show Policy

Failure to arrive on your scheduled check-in date without prior cancellation will result in a no-show charge equal to the full reservation amount.

3.4 Early Departure

Guests who check out before their scheduled departure date may be subject to an early departure fee. Please notify the front desk if you need to modify your departure date.

3.5 Force Majeure

In cases of natural disasters, pandemics, government restrictions, or other circumstances beyond our control, flexible cancellation terms may apply. Contact our reservations team for assistance.

Section 4. Check-In and Check-Out

4.1 Check-In Time

Standard check-in time is 3:00 PM. Early check-in is subject to availability and may incur additional charges. Valid government-issued photo identification and a credit card are required at check-in.

4.2 Check-Out Time

Standard check-out time is 11:00 AM. Late check-out may be available upon request and is subject to availability. Additional charges may apply for late check-out.

4.3 Age Requirements

The primary guest must be at least 21 years of age to check in. Guests under 21 may stay when accompanied by a parent or legal guardian.

Section 5. Guest Conduct and Property Rules

5.1 Quiet Hours

Quiet hours are observed from 10:00 PM to 7:00 AM. Guests are expected to be respectful of other guests during these hours.

5.2 Smoking Policy

JalwaClub Hotel is a non-smoking property. Smoking is only permitted in designated outdoor areas. A cleaning fee of $500 will be charged for smoking in guest rooms or indoor areas.

5.3 Pets

Pets are welcome at select JalwaClub Hotel locations. Pet fees and restrictions apply. Please contact the specific property for pet policy details.

5.4 Events and Gatherings

Parties, events, or gatherings in guest rooms are prohibited without prior written approval. Violation of this policy may result in immediate eviction without refund.

5.5 Damage to Property

Guests are responsible for any damage caused to the room or property during their stay. Charges for damages will be assessed to the guest's account.

Section 6. Payment Terms

6.1 Accepted Payment Methods

We accept major credit cards (Visa, MasterCard, American Express, Discover), debit cards, and digital payment methods. Cash payments may be accepted at select locations.

6.2 Incidentals

A credit card authorization or cash deposit is required at check-in to cover incidental charges. The amount varies by location and length of stay.

6.3 Taxes and Fees

All rates are subject to applicable taxes and fees. Resort fees, where applicable, will be disclosed at the time of booking.

6.4 Billing Disputes

Any billing discrepancies must be reported within 30 days of checkout. Contact our billing department with supporting documentation for resolution.

Section 7. Intellectual Property

7.1 Website Content

All content on the JalwaClub Hotel website, including text, graphics, logos, images, videos, and software, is the property of JalwaClub Hotel or its content suppliers and is protected by copyright and intellectual property laws.

7.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7.3 Trademarks

JalwaClub Hotel, the JalwaClub Hotel logo, and all related marks are trademarks of JalwaClub Hotel Resorts. You may not use these marks without prior written permission.

Section 8. Limitation of Liability

8.1 Personal Property

JalwaClub Hotel is not responsible for loss, theft, or damage to personal property left in guest rooms or elsewhere on the property. Please use in-room safes or front desk safe deposit boxes for valuables.

8.2 Personal Injury

While we strive to maintain a safe environment, JalwaClub Hotel is not liable for injuries sustained during guest activities, except where such injuries result from our proven negligence.

8.3 Service Interruptions

We are not liable for interruptions or errors in website functionality, or for any damages arising from use of our website, including but not limited to direct, indirect, incidental, or consequential damages.

8.4 Maximum Liability

Our total liability to you for any claim arising out of or relating to these Terms or your use of our services shall not exceed the amount paid by you for the reservation giving rise to the claim.

Section 9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

Section 10. Modifications to Terms

JalwaClub Hotel reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after modifications constitutes acceptance of the updated terms. We encourage you to review these Terms periodically.

Section 11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state where the JalwaClub Hotel property is located, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or your stay shall first be submitted to non-binding mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11.3 Class Action Waiver

You agree to resolve any dispute on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Section 12. Miscellaneous Provisions

12.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.2 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of those rights or provisions.

12.3 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. JalwaClub Hotel may assign its rights without restriction.

12.4 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and JalwaClub Hotel regarding the subject matter.
